Home invasion is a felony charge. Home invasion is charged in degrees of first, second, and third. The essential element of home invasion is a breaking and entering or entering without permission into a person’s home.

Home Invasion – First Degree

Home invasion first degree is where a person

• Goes into a home by,
• Either by breaking and entering or entering without permission,
• With the intent to commit or does commit a felony, larceny, or assault,
• With a dangerous weapon, or
• While someone is lawfully present in the home

Home Invasion in the first degree is punishable by up to

• Maximum 20 years in prison
• a $5,000 fine
• The prison term may be consecutive to another sentence

Home Invasion – Second Degree

Home Invasion second degree is where a person

• Goes into a home by,
• Either by breaking and entering or entering without permission,
• With the intent to commit or does commit a felony, larceny, or assault.

Home invasion in the second degree is punishable by

• Maximum 15 years in prison
• $3,000 fine

Home Invasion – Third Degree

Home invasion third degree is where a person

• Goes into a home by,
• Either breaking and entering or entering without permission,
• With the intent to commit or does commit a misdemeanor, or
• The entry into the home violates a term of probation, parole, no-contact order, bond, or personal protection order.

Home invasion in the third degree is punishable by

• Maximum 5 years in prison
• $2,000 fine
