After a DUI arrest most people want to know what penalties they face.
Am I going to Jail?
You are not likely going to jail for the standard first-offense DUI conviction.
The most likely sentence will involve;
- Probation
- Fines and costs
- Community service
- Alcohol testing
- Alcoholics Anonymous meetings
However, there are some courts (some Oakland County courts) that are stricter than others and jail is possible. Also, some factors may increase the chances of jail, such as a bad traffic accident, or a prior DUI charge in the past.
What Happens to My Driver’s License?
Driver’s license sanctions are a concern for most people. The level of driver’s license sanctions will depend on the particular DUI charge you are convicted of. Here is the following consequences:
Operating with a High BAC
- 45-day suspension
- Followed by a year on a restricted license.
- The car must be equipped with an ignition interlock device. The driver must give a breath test sample before the car will start
- Six points on driving record
Operating While Intoxicated
- 30-day suspension
- Followed by five months on a restricted license
- Six points on driving record
Operating While Visibly Impaired
- No suspension
- Three-month restricted license
- Four points on driving record
A second offense of any DUI charge within 7 years of a prior DUI conviction will result in a driver’s license revocation for at least one year. You must go through the driver’s license restoration process to get your license back.
A conviction for an operating while intoxicated offense will permanently go on your record. It can never be expunged.
