What is Legal Marijuana?

Persons 21 and over can use marijuana at home and possess specific quantities in public and at home.

  • In public, a person may possess up to 2.5 ounces of marijuana. No more than 15 grams may be marijuana concentrate.
  • At home, a person may possess up to 10 ounces of marijuana and infused products. May possess up to 12 plants.

There are penalties for possession above the legal limit or improper use. Whether the charge is drugged driving or possession with intent to distribute our Ann Arbor drug attorneys can help. Marijuana charges include:

  • Possession of up to twice the lawful amount of 12 plants or 10 ounces would be a civil infraction for the first two violations.
  • The third violation would be a misdemeanor, punishable by up to 93 days in jail, a fine, or both.
  • Drivers or passengers cannot be actively using marijuana. Drivers cannot be under the influence of marijuana while operating.
What Happens to Past Marijuana Convictions Now That It’s Legal?

Michigan is one of only two states that has legalized marijuana without addressing past convictions. At least one Michigan lawmaker has proposed a new law that would expunge old misdemeanor marijuana convictions. The bill would allow for some felony expungements but would leave that within the discretion of the Court. The specifics of the law are not worked out; however, the goal of the law is to provide relief to people with marijuana convictions on their record. The new law would probably not be voted on and passed before the November election, and there is no guarantee it would pass at all.
